Terms of Service

These terms govern your use of the Yugen Digital Studio website and any services you purchase or engage us for. By using the site, submitting an inquiry or purchasing a package, you agree to these terms. A signed proposal or statement of work, where one exists, takes precedence over this page.

We provide website design and development, social media management and related creative and strategic services. The specific deliverables, timeline and inclusions for your engagement are defined by the package you select or the proposal we agree in writing.

• Project engagements are quoted as one-time fees; content and management engagements are billed monthly in advance.
• Payments are processed by Stripe. Monthly plans continue until cancelled.
• Work begins once the first payment is received. Late or failed payments may pause active work.
• Prices are in US dollars and exclude any applicable taxes.

Monthly engagements can be cancelled at any time and will run to the end of the paid period; we do not pro-rate partial months. Because project work is produced to order, fees for work already completed are non-refundable. If we have not started your project, contact us and we will resolve it fairly.

Timely delivery depends on you: we need access to brand assets, accounts, content, approvals and feedback within reasonable timeframes. You confirm you have the rights to any material you provide us, including images, logos and copy.

Each package includes a defined scope and revision allowance. Additional pages, integrations, platforms or content beyond that scope are quoted as add-ons before we proceed.

Once your invoice is paid in full, you own the final deliverables produced for you. We retain ownership of our underlying tools, frameworks, internal processes and any third-party assets, which remain subject to their own licences. Unless you ask us not to, we may show the finished work in our portfolio.

Engagements may rely on third-party platforms such as hosting providers, social networks, scheduling tools and payment processors. Their availability, policies and pricing are outside our control.

We work to strategy and measurable outcomes, but we cannot guarantee specific business results, rankings, reach or revenue, since these depend on factors beyond our control.

To the extent permitted by law, our total liability arising from an engagement is limited to the fees you paid us for that engagement, and we are not liable for indirect or consequential loss.

Either party may end an engagement with written notice. You remain responsible for fees covering work completed up to that point, and we will hand over completed deliverables that have been paid for.
